N+1 CYCLING TOURS TERMS AND CONDITIONS

 

1. All parties agree to the travel contract, including the following specific conditions:

2. Name of the trip: as established in the travel notes, sent to the guest

3. Date of the tour: as established in the travel notes, sent to the guest

4. Price of the tour: as established in the travel notes, sent to the guest

5. Place of departure and return: as established in the travel notes, sent to the guest

6. Method and schedule of payment: as established in the travel notes, sent to the guest

7. Tour itinerary: as established in the travel notes and complemented with extra documentations sent to the guest before departure. 

8. Accommodation (type, rating and location) and transport provided: as established in the travel notes and complemented with extra documentations sent to the guest before departure. The guest acknowledges that, having been informed of the accommodation and transport information, they have given their agreement to the chosen hotels and transport. Please note: hotels may vary and change based on availability. 

9. Minimum number of people: to run a tour, the minimum number of people that the travel notes states must be met (if a minimum is not required, this clause if not applicable). N+1 Cycling Tours has the right to cancel the trip if a minimum number of people is not reached. Consult the travel notes to find out the specific conditions of your N+1 Cycling Tours trip.

10. Execution and running of a tour: N+1 Cycling Tours is responsible for the correct execution of all the travel services included in the contract (according to Art. 161 of the Proyecto del Ley nº 1/2007). N+1 Cycling Tours will provide adequate assistance without delay to the guest if required. N+1 Cycling Tours may charge a reasonable surcharge for such assistance if the need for assistance has been caused intentionally or by negligence of the guest. Said surcharge shall in no case exceed the actual costs incurred by N+1 Cycling Tours. The guest must inform N+1 Cycling Tours without undue delay of any breach observed during the execution of the tour included in the contract. 

11. Entry requirements: Visas, passports, fees and other necessary documentation may be required, as set out in the travel notes. It is the responsibility of the guest to ensure that they are up-to-date and aware of what is required to enter the country of the trip.

    1. Insurance: Travel insurance is not included any N+1 Cycling Tours service.

    2. Assistance insurance: the contracted trip includes the option of obtaining travel assistance, through an external provider. 

    3. Cancellation insurance: the guest declares that they have been informed by N+1 Cycling Tours about the possibility of contracting external insurance not offered by N+1 Cycling Tours. This will be at the expense of the guest and cover the cancellation costs, the cost of repatriation or transfer to the place of origin, in case of accident, illness or death, as well as other eventualities. 

    4. Insurance in case of insolvency: the purpose of this insurance is to respond to the fulfilment of the obligations derived from the provision of services to the contracting parties of a combined trip and, especially, to reimburse the funds deposited in the event of insolvency or bankruptcy of N+1 Cycling Tours. In accordance with European, Spanish and Catalan legislation, N+1 Cycling Tours has contracted insurance with the following company:

1. Cancellation cost:  Those indicated in the relevant cancellation policy will apply, as established in the travel notes, unless the parties have agreed otherwise.

2. Modification of the trip: Given the characteristics of the trip that relies on external factors (not limited to hotel occupancy, transport availability, road conditions and weather), it may sometimes be necessary to change the itinerary of the contracted trip, either to safeguard the safety of the guests or due to the impossibility of strictly complying with the stated schedule. Both N+1 Cycling Tours and the guest in this contract acknowledge, understand and accept the special and unforeseen characteristics of the contracted trip.

3. Claims. In case of any breach in the execution of the services, the guest is obliged to notify N+1 Cycling Tours reliably and as soon as possible, preferably “in situ” or in any case within five days of the end of the trip. The statute of limitations for actions will be established in Proyecto de Ley nº. RD 1/2007, of November 16.

4. Responsibility. In accordance with the general conditions and applicable legislation, the guest declares: to be in perfect health; to be able to ride a bicycle; to have the necessary control of the equipment they are using; to bring with them any essential and necessary health medication; and to have the necessary travel and health insurance to carry out cycling activities in Europe. The guest is responsible for all damages of material or personal nature that they may suffer. It’s the responsibility of the guest and their companions to respect local traffic regulations and to circulate with care and respect for pedestrians and other users of roads and bike lanes.

5. Special requests: Special requests that the guest have requested before the start of the trip and that N+1 Cycling Tours have accepted will be detailed in the travel notes.

6. Data protection: in compliance with Proyecto de Ley nº. 15/1999, of Decembre 13, of Protección de Datos de Carácter Personal, N+1 Cycling Tours declares that the personal data provided by customers will be integrated into the management files to streamline their administrative and accounting management, as well as the management of services tourism of this contract. Likewise, the client is informed that their data will be communicated to the providers of the contracted services to proceed with the reservation of tickets, accommodation and means of transport, the processing of travel insurance, etc. With regards to the collection and processing of images, the guest must inform N+1 Cycling Tours before the start of the trip if they do not wish to be photographed and if they do wish for their face to be used on any images that could be posted on social media, a website or an advert.

7. Jurisdiction. The contracting parties expressly submit to the jurisdiction of the Courts and Tribunals to resolve discrepancies or claims that may arise from the interpretation or execution of the travel contract and these general conditions, waiving their own jurisdiction if different.

8. Transfer or reservation: the main client can freely transfer the reservation of the trip to a person who meets the conditions required for it. The assignment must be communicated in writing to N+1 Cycling Tours at least 14 days before the start of the trip.

9. Responsibility of the main guest. When the main guest signs on behalf of the other participants of a contracted trip, they declare that they and the other guests in their reservation have read and understood the contract, the travel notes and itinerary. 

 

DEPOSIT AND PAYMENTS

 

Custom, Private and Open tours

To book a N+1 Cycling Tours trip, a deposit of €500 (unless otherwise stated as a different amount) is required at the time of booking. The remaining balance must be paid in instalments, distributed as follows:

• Four months before the N+1 Cycling Tours trip, 50% of the cost must be paid

• Two months before the N+1 Cycling Tours trip trip, 100% of the cost must be paid.

TRAVEL INSURANCE

 

Travel insurance is not included in any N+1 Cycling Tours service, as set out in the terms and conditions. It is the sole responsibility of the guest and it must be purchased prior to the holiday through their own provider. Said insurance must be submitted to N+1 Cycling Tours at least two months before the start of the tour.
